Proje finansmanında teminat due diligence'ının ilk durağı bu sicildir; zira arazi üzerindeki önceki ipoteklerin, geçiş haklarının ve kamu kısıtlarının sırası, kredi verenin tesis edeceği teminatın gerçek önceliğini belirler. Bir hükmün sicilde görünmemesi her zaman yokluğu anlamına gelmez; tescil dışı bazı yasal yükler sicile işlenmeksizin taşınmazı bağlayabilir, ve bu boşluk teminat görüşlerinde ayrıca ele alınır.
English Definition
The part of a land register that records burdens over a property, such as mortgages, easements, notices, and restrictive covenants. In project financing it is the first stop in security due diligence, since the ranking of prior mortgages, rights of way, and public restrictions over the land determines the true priority of the security a lender will take. Absence from the register does not always mean absence of a burden; certain overriding interests can bind the land without registration, and that gap is addressed separately in security opinions.
