English Definition
The proceeding itself, conducted between two private parties to have a right recognised or a loss made good; though in most systems it is synonymous with a civil action, the emphasis here falls on the claimant's burden of proof and the ultimate allocation of costs. The party bringing the suit carries the evidential burden from the outset and, in many jurisdictions, funds the court fees and expert costs up front. In project disputes that drain of cash and time is a quiet pressure that often pushes the parties toward settlement or restructuring before the threshold of trial.
