Altyapı projelerinde komşu arazi sahiplerinden gelen gürültü, çevresel etki ya da ihmal temelli haksız fiil iddiaları gerçek bir izin ve operasyon riskidir; dava, projenin işletmesini durdurabilecek bir ihtiyati tedbire dönüşebilir. Kredi veren bu nedenle söz konusu maruziyetin sigortayla karşılandığını ya da özel amaçlı şirket içinde yalıtıldığını inceler; zira haksız fiil sorumluluğu, sözleşmesel risk tahsisinin dışından gelen bir kaçaktır.
English Definition
A wrongful act or omission outside contract — a tort — that causes harm to another and gives rise to a duty to compensate. In infrastructure projects, tort claims from neighbouring landowners over nuisance, environmental effect or negligence are a genuine permitting and operational risk, since such a suit can escalate into an injunction that halts operation. Lenders accordingly test whether the exposure is insured or ring-fenced within the special-purpose vehicle, because tort liability is a leakage that arrives from outside the contractual allocation of risk.
