Alacak finansmanı ve faktoringde avans oranını belirleyen, alacağı temlik eden tarafın değil, alacak borçlusunun kredibilitesidir; zira geri ödeme nihayetinde ondan tahsil edilecektir. Birçok yargı düzeninde temlikin borçluya ihbarı, temliki üçüncü kişilere karşı hüküm ifade eder ve alacak borçlusunun temlik edene karşı sahip olduğu takas ve def'i haklarını dondurur; bu ihbar, teminat paketinin sessiz ama belirleyici bir bileşenidir.
English Definition
The party on the paying side of a claim or receivable — the person obliged to discharge it. In receivables finance and factoring it is the creditworthiness of the claim debtor, not of the assignor, that sets the advance rate, since repayment is ultimately collected from that party. In many jurisdictions notice of the assignment to the debtor perfects it against third parties and freezes the set-off and defences the debtor held against the assignor; that notice is a quiet but decisive component of the security package.
