English Definition
A defendant joined to a class action as representative of a defined class of defendants — a defendant class action. Rarer than the plaintiff class, it arises where many parties share the same liability, for instance where numerous holders of identical securities are implicated. Conducted through a representative defendant, the structure raises the question whether the judgment binds absent members of the class, and that question of binding effect determines both the efficiency and the legal fragility of the device.
