English Definition
In a contract, each of two or more contractors who jointly undertake a single obligation toward an employer or client, usually working under a consortium or joint-venture structure. In large EPC work the decisive question is whether the co-contractors' liability is joint and several or merely several; the employer typically insists on joint and several liability so it can hold any one contractor answerable for the whole, while the contractors prefer several liability confined to their own scope, and this distinction determines the ultimate allocation of delay damages and defect risk.
