English Definition
A reference to the legal-institutional framework of European integration and the predecessor of the European Union, the carrier of the single market, the customs union and the common regulatory acquis. For project finance its significance is that state-aid control, the competition regime and sectoral directives constrain the incentive and tariff structures available at member-state level; public support given to a renewable-energy or infrastructure project carries a clawback risk where it is not compatible with this higher rule-set. Accordingly, cross-border legal due diligence confirms compliance at this Community level in addition to national law.
