Belirli bir uyuşmazlığı ya da işlemi hukuken görme yetkisine sahip mahkeme veya idari mercidir; sözleşmelerde sıkça geçen 'yetkili yargı mercii kararı' ibaresi, hükmün ancak böyle bir merci tarafından verildiğinde tanınacağını varsayar. Proje sözleşmelerinde bu ifade standart bir kalıp gibi görünse de, hangi mercinin yetkili sayılacağı teminatın icrasının fiilen nerede gerçekleşeceğini belirler. Ev sahibi devletin taraf olduğu sözleşmelerde egemenlik muafiyeti (sovereign immunity) feragati ile yetkili mercii şartının birlikte okunması gerekir; aksi halde kâğıt üzerindeki yetki, uygulamada işletilemez bir hükme dönüşebilir.
English Definition
The court or administrative body legally empowered to hear a given dispute or matter; the contractual phrase 'court of competent jurisdiction' presumes that a ruling will be recognized only where rendered by such a body. Though the phrase reads as standard boilerplate in project contracts, which forum qualifies as competent determines where enforcement of security actually occurs. In agreements to which a host state is party, the competent-jurisdiction clause must be read together with any waiver of sovereign immunity; absent that, authority on paper can collapse into an unenforceable provision in practice.
