Borçlunun, birden fazla edimin tamamını birlikte ifa etmekle yükümlü olduğu, seçimlik borcun aksine edimlerden yalnızca birini ifa ederek borçtan kurtulamadığı borç türüdür. Proje finansmanı sözleşmelerinde EPC yüklenicisinin hem tesisi teslim etme hem de performans testlerini geçirme yükümlülüğü gibi kümülatif taahhütler bu yapıda kurgulanır; edimlerden birinin ifa edilmemesi, diğerleri tamamlanmış olsa dahi temerrüt doğurur. Kredi verenler açısından bu ayrım kritiktir, zira teminat paketinin tetiklenmesi çoğu zaman tek bir edimin değil, bağlı edimler bütününün ifasına bağlanır.
English Definition
An obligation under which the debtor must perform every one of several distinct objects together and, unlike an alternative obligation, cannot discharge the debt by rendering only one of them. In project finance documentation such cumulative undertakings appear where an EPC contractor must both deliver the plant and pass performance tests, so that failure of one limb constitutes default even where the others are complete. The distinction matters to lenders because enforcement of the security is frequently keyed not to a single covenant but to the integral performance of a bundle of linked obligations.
