Bir gayrimenkul veya varlık üzerindeki hukuki mülkiyetin, tapu veya devir senediyle bir taraftan diğerine geçirilmesi işlemidir; hem eylemin kendisini hem devri gerçekleştiren belgeyi ifade eder. Proje finansmanında önemi, arazi mülkiyetinin veya kullanım hakkının proje şirketine temiz biçimde geçmesinin, kredi verenin rehin tesis edebilmesinin ön koşulu olmasıdır; devir zincirinde bir kopukluk ya da tescilsiz irtifak, kapanışı geciktiren tipik bir due diligence bulgusudur. Devrin geçerliliği çoğu kez yerel tapu sicilinin güvenilirliğine bağlıdır.
English Definition
The transfer of legal title over real property or an asset from one party to another by deed or instrument; it denotes both the act and the document that effects it. Its importance in project finance is that clean passage of land title or use rights to the project company is a precondition for the lender to perfect its security; a break in the chain of conveyance or an unregistered easement is a typical diligence finding that delays close. The transfer's validity often depends on the reliability of the local land registry.
