Bir tahkim yargılamasında hakemlerin ücret ve masrafları ile yönetim kurumunun (ICC, ICSID, LCIA gibi) idari giderlerini kapsayan, tarafların davayı yürütmek için kendi katlandıkları hukuki masraflardan ayrı tutulan kalemdir. Nihai kararda bu masrafların hangi tarafa yükleneceği 'masraf kaybedene aittir' ilkesiyle sabit değildir; heyet çoğu zaman tarafların usuli davranışını ve taleplerdeki başarı oranını tartarak bölüştürür. English Definition
In an arbitration, the item covering the arbitrators' fees and expenses together with the administering institution's charges (ICC, ICSID, LCIA and the like), kept distinct from the parties' own legal costs of pursuing the case. Which side bears them is not fixed by a simple 'costs follow the event' rule; the tribunal typically apportions them by weighing the parties' procedural conduct and relative success on the claims. In project contracts, the institution and seat chosen in the dispute clause set the scale and predictability of these costs at the outset — a term too often passed over in haste.
