English Definition
The act by which a debtor creates over a specified asset, in favor of a creditor, a legal right giving that creditor priority in recovery should the debt go unpaid; it may take the form of a pledge, mortgage or assignment. Merely creating the right is not enough; for it to bind third parties the relevant registration or filing must also be completed. In project finance the heart of the security package is the comprehensive security interest created in favor of the lenders over all the project company's tangible and intangible assets, and the moment this right is perfected, together with its priority ranking, is the real determinant of who recovers what in a default.
