Proje finansmanında güven beyanı, teminat vekilinin (security trustee) teminatı tüm sendikasyon üyeleri adına elinde tutmasını mümkün kılan yapısal temeldir; bu sayede tekil kredi verenler değişse dahi teminat yapısı bozulmaz. English Definition
A legal document by which the holder of legal title to property formally declares that it holds that property for the benefit of another — the beneficiary — establishing the trust relationship between trustee and beneficiary. In project financing a declaration of trust is the structural foundation that lets a security trustee hold collateral on behalf of all syndicate members, so the security structure survives even as individual lenders change. The difference in how the trust concept is recognised between common-law and civil-law systems is an often-overlooked structural risk that governs which law the security is subjected to in cross-border transactions.
