Bir belgenin imzalanmış olması ile usulüne uygun imzalanmış olması aynı şey değildir; ikincisi, imzanın yalnızca varlığını değil, hukuki geçerliliğini doğuran koşulların bütününü kapsar. Sınır ötesi işlemlerde bu ayrım kritik hale gelir; kimi jurisdiction'lar apostil, ıslak imza ya da belirli tescil formaliteleri ararken, bu formalitelerdeki bir eksiklik belgeyi ispat ya da icra aşamasında zayıf düşürür, bu yüzden kapanış paketleri imza formalitelerinin tamamlandığını ayrıca teyit eder.
English Definition
A term denoting that a document has been signed fully and in accordance with the rules, so as to satisfy every formal condition required for validity — signatures of authorised persons and, where needed, a witness, notarisation or seal. A document being signed and its being duly signed are not the same: the latter captures not merely the presence of a signature but the whole set of conditions that give it legal effect. In cross-border transactions this distinction becomes critical, since some jurisdictions require an apostille, a wet-ink signature or particular registration formalities, and a shortfall in these formalities weakens the document at the stage of proof or enforcement, which is why closing packages separately confirm that signing formalities are complete.
