Sozlesmeden veya kanundan dogan haklarin belirlenen sure icinde kullanilmamasi olup, bu durum haklarin dusmesine veya feragat edilmis sayilmasina yol acabilir. Finansta opsiyonlarin, donusturme haklarinin veya oncelik haklarinin suresi icinde kullanilmamasini kapsar. Cogu sozlesme, geciken kullanimin haktan kalici feragat teskil etmedigini belirten koruyucu hukumler icerir.
English Definition
The non-exercise of contractual or legal rights within the prescribed timeframe, which may result in lapse or waiver of those rights. In finance, this includes failure to exercise options, conversion rights, or pre-emptive rights before their expiry. Most agreements contain savings clauses to clarify that delayed exercise does not constitute a permanent waiver of rights.
