Kiralama ve kullanim sozlesmelerinde yaygin olarak bulunan, kiracinin veya kullancinin zaman icinde olagan kullanim sonucu olusan normal yipranmadan dolayi sorumluluktan muaf tutuldugu bir sozlesme hukmu. Kiraci yalnizca makul yipranmanin otesindeki hasarlardan sorumlu tutulur. Bu hukum operasyonel kiralama, ekipman kiralama ve gayrimenkul kiralama sozlesmelerinde standart olarak yer alir.
English Definition
A contractual clause commonly found in lease and rental agreements that exempts the tenant or user from liability for normal deterioration of property or equipment resulting from ordinary use over time. The lessee is responsible only for damage beyond what is considered reasonable wear. This provision is standard in operating leases, equipment hire contracts, and real estate tenancy agreements.
