Görünürde maliyetsiz olsa da muhasebe ve vergi açısından nötr değildir. Sınır ötesi proje tedarikinde bedelsiz gönderilen ekipman ya da yedek parça, fiili bir fatura tutarı bulunmasa dahi gümrük değerlemesine ve transfer fiyatlandırması incelemesine tabidir; ilişkili taraflar arası FOC teslimatlar, vergi idaresince örtülü kazanç aktarımı olarak nitelendirilme riski taşıdığından, EPC ile O&M sözleşmelerinde ayrı bir kalem olarak belgelendirilmeleri gerekir.
English Definition
A commercial term indicating that goods, a service or a delivery are supplied without charge to the counterparty, common for spare parts, samples and warranty-scope deliveries. Although apparently costless, it is not neutral for accounting and tax purposes. In cross-border project procurement equipment or spares shipped free of charge remain subject to customs valuation and transfer-pricing review even where no invoice amount exists; FOC deliveries between related parties carry the risk of being characterised by the tax authority as a disguised transfer of profit, which is why they should be documented as a separate line in EPC and O&M contracts.
