Misli şeyler, birbirinin yerine geçebilen ve aynı tür, kalite ve miktardaki eşdeğer birimlerle ikame edilebilen mallar, varlıklar veya enstrümanlar için kullanılan toplu terimdir. Medeni hukuk geleneğinde misli şeyler, satış, ödünç ve tevdi sözleşmelerindeki yükümlülüklerin belirlenmesi amacıyla misli olmayan (belirli, benzersiz) kalemlerle karşılaştırılır. Bir varlığın hukuken misli olarak sınıflandırılması, iade veya ikame yükümlülüğünün niteliğini etkiler.
English Definition
Fungibles is the collective term for goods, assets, or instruments that are interchangeable and can be substituted by equivalent units of the same kind, quality, and quantity. In civil law traditions, fungibles are contrasted with non-fungibles (specific, unique items) for purposes of determining obligations in contracts of sale, loan, and deposit. The legal classification of an asset as fungible affects the nature of the obligation to return or replace it.
