Gelecekteki mallar, satış sözleşmesinin yapıldığı tarihte henüz mevcut olmayan veya satıcının zilyetliğinde bulunmayan kalemlerdir. Sözleşme tarihinden sonra imal edilecek, yetiştirilecek veya başka bir şekilde edinilecek malları kapsar. Ticaret hukuku kapsamında gelecekteki malların satışına ilişkin sözleşme, kesin bir satış değil satış vaadi niteliğinde işlem görür ve mülkiyet ancak malların var olması ve sözleşmeye koşulsuz olarak tahsis edilmesi üzerine alıcıya geçer.
English Definition
Future goods are items that do not yet exist or are not yet in the possession of the seller at the time a contract of sale is entered into. They include goods to be manufactured, grown, or otherwise acquired after the contract date. Under commercial law, a contract for the sale of future goods operates as an agreement to sell rather than an outright sale, with title passing to the buyer only upon the goods coming into existence and being unconditionally appropriated to the contract.
