Maddesinde yer alan ve üye devletlerin kamu ahlakı, insan sağlığı veya tükenebilir doğal kaynakların korunması için ticaret yükümlülükleriyle çelişen önlemler almasına izin veren hüküm. Serbest ticaret taahhütleri ile meşru politika hedefleri arasında denge kurar. Uygulanması sıkı zorunluluk ve ayrımcılık yapmama testlerine tabidir.
English Definition
A provision in international trade agreements, most notably Article XX of the GATT, that permits member states to adopt measures otherwise inconsistent with their trade obligations when necessary to protect public morals, human health, exhaustible natural resources, or other specified interests. General exceptions serve as safety valves in the multilateral trading system, balancing free trade commitments with legitimate policy objectives. Their invocation is subject to strict tests of necessity and non-discrimination.
