English Definition
The act of a creditor granting an extension of the payment deadline to a principal debtor beyond the originally agreed maturity date, without the consent of a surety or guarantor. Under suretyship law, giving time to the principal debtor without the guarantor's agreement may discharge the guarantor from liability, as it materially alters the risk that the guarantor originally assumed. This doctrine is a fundamental principle of guarantee law and is frequently addressed in guarantee and indemnity clauses of financing documentation.
