English Definition
A legally recognised justification or mitigating circumstance that may relieve a party from liability for non-performance, delay, or breach of a contractual or legal obligation. In civil law systems, good excuse encompasses force majeure events, impossibility of performance, and circumstances beyond the party's reasonable control. Courts evaluate the legitimacy of a good excuse by assessing whether the preventing event was foreseeable, avoidable, and whether the affected party took all reasonable steps to mitigate its consequences.
