Fiziksel zilyetligi veya hukuki mulkiyeti kredi verene devretmeksizin bir varligi kredi teminatina olarak rehin etme uygulamasidir. Borcalu, kredi verene temerrut halinde infaz edilebilecek bir teminat hakki tanirken varligi kullanma hakkini muhafaza eder. Ipotek tesisi gemi finansmani, emtia kredilendirmesi ve menkul kiymet marj hesaplarinda yaygin olarak kullanilir; bu durumlarda rehinli varliklar borcalinin operasyonel kontrolunde kalmaya devam eder.
English Definition
The practice of pledging an asset as collateral for a loan without transferring physical possession or legal title to the lender. The borrower retains the right to use the asset while granting the lender a security interest that can be enforced upon default. Hypothecation is widely used in shipping finance, commodity lending, and securities margin accounts, where the pledged assets remain in the borrower's operational control.
