English Definition
The procedural moment at which the exchange of pleadings closes and the factual or legal question on which the parties disagree emerges clearly, after which the proceeding focuses on proving the contested point. The crystallization of the dispute in this form determines the scope of evidence gathering and witness presentation. In project and construction arbitration the significance of this stage is that it fixes the real axis of the dispute: though parties often open with broad claims, once issue is joined the case narrows to a few decisive technical and contractual questions, and the true cost of litigation risk can be priced reliably only after that narrowing occurs.
