Bir sozlesmenin birden fazla borclusunun, edimin tamami bakimindan hem birlikte hem de ayri ayri yukumlu oldugu borc iliskisidir; her borclu alacakliya karsi butun edimden sorumludur, ic paylasim ise yalnizca borclular arasindaki iliskiyi ilgilendirir. English Definition
A contractual relationship in which several debtors are obliged for the whole of the performance both together and individually; each debtor is answerable to the creditor for the entire obligation, while the internal split concerns only the relationship among the debtors. The structure lets the creditor diversify its collection risk across the debtors. In multi-contractor agreements the way a joint and several obligation is defined is critical: whether the contract renders a duty joint and several or divided determines whether the creditor can demand full performance from a single contractor, and leaving that distinction unwritten is a gap that quietly weakens collection leverage in a performance dispute.
