English Definition
A responsibility structure in which several parties are held accountable, both together and each in full, for the same performance or obligation, so the counterparty may direct its claim over the whole outcome to any one party alone. It is the enforceability- and indemnity-facing manifestation of joint and several liability. In consortium or joint-venture tenders the employer often requires the partners' joint and several responsibility: this gives the employer full recourse to the others should one partner's technical or financial failure imperil the entire project, and it compels the partners to scrutinize one another's performance capacity closely before closing.
