Birden fazla tarafin ayni edim bakimindan birlikte -fakat muteselsil olmayan- yukumluluk altina girdigi sozlesmedir; alacakli, kural olarak edimi butun borclulardan birlikte talep etmek ve dava etmek zorundadir, tek bir borcluyu butun borctan takip edemez. Bu yon, onu muteselsil borctan keskin biciminde ayirir ve alacakli acisindan daha zayif bir konum uretir. English Definition
A contract in which several parties assume a joint, but not several, obligation for the same performance; as a rule the creditor must demand and sue all debtors together and cannot pursue a single debtor for the whole debt. This sharply distinguishes it from a joint and several obligation and produces a weaker position for the creditor. In multi-party project contracts the framing is decisive: if the contract provides only joint liability, one debtor's insolvency may release the others from full performance and tie the creditor's collection path to bringing all parties before the forum at once.
