English Definition
Each of two or more debtors liable together for the same debt; the scope of that liability turns on whether the debt is joint or joint and several. Under a purely joint debt the creditor must pursue the debtors together, whereas under a joint and several debt it may pursue each alone for the whole. In intragroup funding and cross-guarantee structures the position is critical: adding group companies as joint debtors to an SPV's debt offers the lender a wider asset pool but spreads a cross-obligation from the standpoint of the debtor companies' own creditors, weighting the consolidated risk profile.
