Musterek Sorumluluk (Joint Liability)
English Definition
A condition in which several parties are held liable together, but not severally, for the same obligation; as a rule the creditor must claim against all of them together and cannot pursue a single party for the whole debt. This distinguishes it from joint and several liability, under which each party is answerable alone for the full amount, and produces a weaker position for the creditor. The distinction is decisive in multi-party financing structures: where liability is only joint, one party's insolvency may release the others from full performance, weakening the creditor's collection leverage at precisely the moment of default when it is most needed.
