Birden fazla borclunun tek ve bolunmemis bir edim bakimindan birlikte yukumlu oldugu borc iliskisidir; edim butun borclulara ait tek bir yukumluluk olarak dogar ve alacakli, kural olarak bunu borclulardan birlikte talep eder. Muteselsil borctan farki, alacaklinin tek bir borcluyu butun edimden tek basina sorumlu tutamamasidir. Sozlesme tekniginde bir yukumlulugun musterek mi muteselsil mi kuruldugu, cogu zaman standart bir yorum kuraliyla degil sozlesmenin acik lafziyla belirlenir; bu nedenle cok-tarafli proje sozlesmelerinde muteselsillik acikca yazilmadiginda, birçok hukuk sisteminde varsayilan yorum edimi musterek sayarak alacaklinin basvuru gucunu daraltir.

English Definition

A debt relationship in which several debtors are obliged together for a single, undivided performance belonging to all of them, which the creditor as a rule demands from the debtors together. It differs from a joint and several obligation in that the creditor cannot hold a single debtor answerable alone for the whole. In drafting, whether an obligation is joint or joint and several turns on the express words of the contract rather than a rule of construction; where several liability is not written out in multi-party project contracts, the default reading in many legal systems treats the performance as joint and narrows the creditor's recourse.
