English Definition
The party against whom a court judgement has been entered and who is bound to pay the sum it fixes. Because the judgement creditor can attach the debtor's bank accounts, receivables and assets, an SPV falling into the position of judgement debtor can expose the accounts within the project's cash waterfall, including the debt-service reserve account, to seizure. Lenders guard against this by seeking to give their pledge and control over the secured accounts priority over third-party attachments.
