Juri bir yonde karar verdikten sonra, hakimin makul hicbir jurinin o sonuca varamayacagi kanaatiyle karari lehine oldugu tarafi degistirerek verdigi hukumdur; ABD federal usulunde bugun buyuk olcude hukuk meselesi olarak yenilenen karar talebi bicimine tasinmistir. Delil, bir tarafi lehine o denli belirleyici oldugunda uygulanabilir ve temyiz asamasinda sikca tartisilir. Proje finansmaninda onemi, kosullu yukumlulukleri ve garanti/tazminat hukumlerini fiyatlarken; ilk derece juri kararinin nihai olmadigini, dolayisiyla dava riskinin beklenen degerinin bu tersine cevrilme olasiligiyla birlikte modellenmesi gerektigini gostermesidir.
English Definition
A ruling in which the judge, finding that no reasonable jury could have reached the verdict returned, enters judgment for the opposing party; in US federal practice it now largely survives as the renewed motion for judgment as a matter of law. It applies only where the evidence points decisively one way and is frequently litigated on appeal. Its relevance in project financing is in pricing contingent liabilities and indemnity provisions: a first-instance jury verdict is not final, so the expected value of litigation exposure must be modeled together with this probability of reversal.
