English Definition
The term is used in two senses: narrowly, the summons and papers a court serves on a defendant; broadly, the whole judicial mechanism by which a dispute is resolved. In cross-border project finance, how valid service is effected on a foreign SPV is a practical problem, which is why agreements commonly require the appointment of an agent for service of process within the jurisdiction. The absence of that agent-for-service clause can vitiate, at the enforcement stage, a judgement that would otherwise stand.
