Bir işlemin ya da hakkın mahkeme eliyle, yargısal usul izlenerek gerçekleştirilmesini niteleyen ifadedir. Teminatın paraya çevrilmesinde bu kavram belirleyicidir: yargısal yolla yapılan cebrî satış (judicial foreclosure), mahkeme denetimi altında yürüdüğü için daha yavaştır ama borçlunun geri alım hakkını kesin biçimde sona erdirir; yargı-dışı yol ise hızlıdır ama itiraza daha açıktır. Proje finansmanında kredi verenin teminatı ne kadar sürede ve hangi kesinlikte nakde çevirebileceği, büyük ölçüde bu yolların hukukî tasarımına bağlıdır.
English Definition
The term describing that an act or right is effected through a court, following judicial procedure. It is decisive in the realization of security: a judicial foreclosure, conducted under court supervision, is slower but extinguishes the debtor's right of redemption conclusively, whereas the non-judicial route is faster but more open to challenge. In project finance, how quickly and with what certainty a lender can turn its security into cash depends largely on the legal design of these routes.
