Dava zamanaşımı, bir dava sebebinin oluşmasını takiben tarafın hukuki işlem başlatması gereken azami süreyi belirleyen hukuki ilkedir. Bu süre dolduğunda talebin haklılığından bağımsız olarak dava açma hakkı düşer. Sözleşmesel, haksız fiil veya yasal talepler gibi farklı talep türleri farklı zamanaşımı sürelerine tabi olabilir. Uluslararası proje finansmanında uygulanacak zamanaşımı süresi sözleşmenin tabi olduğu hukuka bağlıdır.
English Definition
Limitation of actions is the legal doctrine that prescribes the maximum period within which a party must commence legal proceedings following the occurrence of a cause of action. Once this period expires, the right to bring the action is extinguished regardless of the merits of the claim. Different types of claims may be subject to different limitation periods. In international project finance, the applicable limitation period depends on the governing law of the contract.
