Para borçlanması, kredi verenin bir miktar paranın mülkiyetini borçluya devretmesi ve borçlunun kararlaştırılan zamanda genellikle faizle birlikte aynı para biriminde eşdeğer tutarı iade etmekle yükümlü olduğu sözleşmedir. Aynı belirli kalemlerin iade edilmesi gereken mal ödüncünden farklı olarak para borçlusu eşdeğer tutar geri ödendiği sürece fonları serbestçe kullanabilir. Bu, tüm banka kredilendirme ve proje finansmanı borç tesislerinin temelini oluşturan temel hukuki kavramdır.
English Definition
A loan of money, also known as mutuum, is a contract in which the lender transfers ownership of a sum of money to the borrower, who is obligated to return an equivalent amount of the same currency at the agreed time, typically with interest. Unlike a loan of goods where the same specific items must be returned, the borrower in a loan of money may use and dispose of the funds freely, provided the equivalent sum is repaid. This is the foundational legal concept underlying all bank lending and project finance debt facilities.
