Bir ihalede, ihale dokümanının şart ve koşullarına esaslı bir sapma olmaksızın uyan teklifler arasından en düşük fiyatlıyı ifade eder; esas itibarıyla uygunluk (substantial responsiveness) burada eşik koşuldur. Bir teklifin fiyatı ne kadar cazip olursa olsun, kapsam, garanti, teslim veya risk paylaşımında maddi bir sapma taşıyorsa değerlendirmeden elenir ve fiyat sıralamasına hiç girmez. MDB ve kamu satın alma rejimlerinde bu ilke, ihale bütünlüğünü korumanın temelidir; zira maddi sapmaların pazarlıkla düzeltilmesine izin vermek, ilan edilen rekabet zemininin dışında bir yeniden müzakereye kapı açar ve diğer istekliler açısından ihaleyi geçersiz kılar.
English Definition
In a tender, the lowest-priced offer among those that comply with the terms and conditions of the tender documents without a material deviation; substantial responsiveness is the threshold condition here. However attractive its price, a tender carrying a material deviation in scope, warranty, delivery, or risk allocation is eliminated from evaluation and never enters the price ranking at all. In MDB and public procurement regimes this principle is the basis of tender integrity, because permitting material deviations to be cured by negotiation opens the door to a re-negotiation outside the declared competitive basis and vitiates the tender for the other bidders.
