Bir kamu görevlisinin görevini dürüstlükle ve yasaya uygun ifa edeceğini teminat altına alan, kefil (surety) tarafından düzenlenmiş güvence senedi; görevlinin ihmal ya da suistimalinden doğan zararlar bu teminattan karşılanır. Proje finansmanında doğrudan bir enstrüman olmamakla birlikte, kavram surety bond mantığının kamu hukukundaki karşılığıdır ve performans teminatlarının (performance bond) risk transfer mekaniğiyle aynı zemine oturur. Teminatın gerçek değeri, kefilin kredi kalitesi ve talep üzerine ödeme yükümlülüğünün koşulsuzluğu ile ölçülür.
English Definition
A surety instrument guaranteeing that a public official will discharge their duties honestly and in accordance with law, under which losses arising from the official's negligence or misconduct are met from the bond. Though not a direct project finance instrument, the concept is the public-law counterpart of surety bonding and rests on the same risk-transfer mechanics as a performance bond. The real value of such a bond is measured by the surety's credit quality and by whether its payment obligation is unconditional and payable on demand.
