Proje finansmanında bir varlığın kime ait olduğu göründüğünden daha katmanlıdır: hukuki mülkiyet (legal title) çoğu zaman özel amaçlı şirkette dururken, kredi veren lehine tesis edilen rehin ve temlik nedeniyle intifa ve tasarruf hakkının ekonomik gerçekliği finansörlere kaymıştır; bu nedenle 'sahip olunan' varlık, temerrüt anında sponsordan çok kredi verenin kontrolündeki bir teminattır.
English Definition
The legal attribute distinguishing an asset held by a party with full title over it from assets that are leased, borrowed, or over which only a right of use is transferred. In project finance, who owns an asset is more layered than it appears: legal title usually rests in the special-purpose vehicle, yet through the security and assignment granted in the lender's favor the economic reality of use and disposal has shifted to the financiers; an 'owned' asset is therefore, on default, collateral under the lender's control more than the sponsor's.
