English Definition
In its most general sense, a party's fulfilment of the obligation it has undertaken, or the degree to which an asset, process or organisation produces a measurable result; in a legal context it denotes performance of the contract, in a financial context return and efficiency. The two senses frequently interlock within the same transaction. In project financing performance is the hinge that binds the technical and financial layers; a power plant passing its contractual performance test — guaranteed output, heat rate — not only completes the EPC contractor's performance but also triggers the project's commercial operation date threshold and hence the start of debt service, which is why technical performance and financial calendar lock together in a single provision.
