English Definition
A natural or legal person vested with governmental or public power. In concession and PPP arrangements and in project agreements, the acts of a person exercising public authority — revoking a permit, changing the law, expropriating — trigger change-in-law and political-force-majeure provisions, giving rise to a right to compensation or tariff adjustment. The scope of the definition, meaning which bodies fall within it, is heavily negotiated, because it silently allocates political risk between the project company and the granting authority.
