English Definition
The port, recorded in the transport documents, at which the goods are loaded onto the vessel and the sea carriage effectively begins, and under many delivery terms the point of departure at which risk and cost pass. Under FOB and similar terms, risk passing to the buyer once the goods cross the ship's rail makes the port of shipment and the shipment date critical under a letter of credit, where the on-board bill of lading date determines compliance with the latest-shipment condition. Exceeding that date by even a single day can render an otherwise flawless presentation non-conforming and place payment at risk.
