English Definition
The extinction, or in some cases the acquisition, of a right through the lapse of a period fixed by law where the right has gone unexercised or a claim unasserted; the civil law notion functionally overlaps with limitation in common law systems. In cross-border project finance the variation of prescription periods across governing laws is material: the window allowed for enforcing security or advancing a damages claim directly determines the real enforceability of the security package, which is why counsel maps the relevant periods under both the credit law and the local security law.
