Bir kurumun belirli bir piyasada ya da yargı bölgesinde yerleşik biçimde faaliyet gösterme kapasitesini; şube, iştirak ya da tescilli varlık yoluyla kurduğu operasyonel ayak izini anlatır. Bir finans kuruluşu için yerel varlık salt ticari değil, düzenleyici bir eşiktir: yerel para cinsinden borç verebilme, mevduat toplayabilme ve daimi işyeri (permanent establishment) nedeniyle vergiye tabi olma statüsü bu varlığın hukuki niteliğine bağlıdır; dolayısıyla sınır ötesi kredide yerel varlık kurmadan ödünç vermek çoğu zaman stopaj ve tescil sürtünmeleriyle fiyatlanır.
English Definition
The capacity of an institution to operate on an established footing in a given market or jurisdiction, describing the operational footprint it builds through a branch, subsidiary or registered entity. For a financial institution local presence is not merely commercial but a regulatory threshold: the ability to lend in local currency, take deposits, and its exposure to tax as a permanent establishment all turn on the legal character of that presence, so cross-border lending without establishing presence is typically priced with withholding and registration frictions that a purely commercial reading overlooks.
