Kritik incelik, ibrazın süresinde yapılması ve karşılıksızlık hâlinde usulüne uygun ihbarın (notice of dishonor) verilmesinin, ciranta ve diğer ikincil sorumluların rücû yükümlülüğünü ayakta tutmasıdır; ibrazın ihmali ise bu tarafların sorumluluğunu düşürerek alacaklının başvurabileceği muhatap kümesini daraltır.
English Definition
The formal submission of a negotiable instrument — a cheque, bill of exchange or promissory note — to the party bound to pay or accept it, with a demand for payment or acceptance; under the law of negotiable instruments the preservation of rights turns on this act. The critical subtlety is that timely presentment, followed by proper notice of dishonour, keeps alive the recourse liability of endorsers and other secondary parties; failure to present discharges them, narrowing the set of obligors a holder can pursue, a consequence that matters most where the primary obligor is the least creditworthy.
