English Definition
Evidence sufficient to establish a fact or a right unless rebutted, shifting the burden of proof onto the other party. Prima facie evidence is not conclusive; it merely creates a presumption and requires the opposing party to adduce evidence that displaces it. In project finance documents, clauses providing that the lender's own account records are 'prima facie evidence' of the borrower's default and of the outstanding balance are common; such a clause shifts the evidential burden onto the borrower in a dispute and markedly accelerates the creditor's path to enforcement.
