English Definition
In suretyship law, the debtor that owns the debt and whose performance the surety secures; because the surety's liability is accessory to this principal debtor's obligation, the suretyship ends when the principal debt is extinguished and the surety may as a rule raise the defenses available to the principal debtor. This accessory character includes the benefit of discussion — beneficium excussionis — requiring the creditor to pursue the principal debtor before turning to the surety. In project financing, casting sponsor guarantees as 'on-demand' and 'as primary obligor' is designed precisely to disable these accessory defenses and give the creditor a direct, unconditional right of recourse.
