English Definition
In a cooperative ownership structure, a special lease granting a holder of cooperative shares the right to occupy a particular unit in the building the cooperative owns; the occupant is not the owner of the unit but simultaneously a shareholder of the cooperative and a lessee tied to that shareholding. This dual structure creates a financing difficulty: since the resident's collateral is not the property itself but the cooperative shares and the attached lease right, lenders require a pledge over the shares and recognition agreements rather than a classic mortgage. Any underlying mortgage on the building beneath the cooperative must be examined with care, as it ties the value of all units to a shared risk.
