Bir kişinin bir varlık üzerinde sahip olduğu ve herkese karşı ileri sürülebilen mülkiyet hakkıdır; salt sözleşmeden doğan ve yalnızca karşı tarafa yöneltilebilen kişisel haktan, bu 'herkese karşı' (erga omnes) niteliğiyle ayrılır. English Definition
A right of ownership a person holds over an asset and can assert against all; it differs from a personal right, which arises merely from contract and can be directed only at the counterparty, by this erga omnes, against-all, character. The practical weight of the distinction emerges when the asset changes hands or the debtor becomes insolvent: the holder of a proprietary right can trace the asset even into third-party hands, while the holder of a personal right may have to settle for damages alone. In project finance the strength of security rests precisely on this character, for the pledge and mortgage the lender takes over the project's assets secure priority at the insolvency table only when constituted as proprietary rights.
