English Definition
A bill of exchange whose dishonor, by non-payment or non-acceptance, has been formally documented through protest; it ceases to be an ordinary trade claim and becomes an instrument in the enforcement phase, carrying the holder's rights of recourse against endorsers and the drawer. The existence of a protested bill is a strong negative signal about the debtor's standing. In discounting and factoring portfolios these instruments form a distinct risk class, and because recourse depends on the protest having been effected within the prescribed period, a portfolio buyer scrutinizes protest dates and the notice chain closely in diligence.
